These Terms govern access to and use of Wave. By using the website, you agree to these Terms. If you do not agree, do not use the website.
1.About Wave
Wave is a free, independent information service that indexes publicly available Australian grappling and Brazilian jiu-jitsu competition information. The service may display athlete names, academies, belts, event registrations, divisions, opponents, match outcomes, methods and placements, together with statistics derived from those records.
Wave is not a competition organiser, governing body, ranking authority or official results service. Wave is not affiliated with, sponsored by, approved by or endorsed by Smoothcomp, any federation, academy, athlete or event organiser. Third-party names and trade marks belong to their respective owners.
2.Public records and data sources
Information is compiled from public competition pages and records made available by third parties, including Smoothcomp-hosted pages and event organisers. Wave may normalise names, link records that appear to concern the same athlete, calculate totals and present the information in a different format.
Public availability does not make a record complete, current or error-free. Source pages may change, contain errors or identify different people by the same or similar name. Wave does not independently verify every result or identity.
3.No official record or professional advice
The website is provided for general information and discovery only. It must not be treated as an official sporting record, eligibility determination, selection decision, safety assessment, background check, evidence of identity, or legal, medical, financial or professional advice.
Before relying on information for any material decision, verify it with the relevant athlete, event organiser, federation or original source. You remain responsible for how you interpret and use the information.
4.Permitted use
You may browse, search, link to and quote limited portions of the website for lawful personal, journalistic, research or non-commercial purposes, provided that you identify Wave as the source of the presentation and do not suggest that Wave verifies or endorses your use.
No other licence is granted. Any use of third-party material remains subject to the rights of the relevant third party.
5.Prohibited use
You must not use the website or its data to:
- break any law, court order, regulatory requirement or third-party right;
- harass, threaten, shame, discriminate against, stalk or otherwise harm an athlete or another person;
- make eligibility, employment, insurance, credit, housing or other high-impact decisions about a person;
- identify, target, profile or exploit a child or young person;
- misrepresent a record, impersonate another person or falsely claim affiliation with Wave;
- sell, license, republish or create a competing bulk database from a substantial part of the website;
- scrape or query the service at a volume or rate that degrades availability or bypasses access controls;
- probe, interfere with or compromise the website, database, infrastructure or security controls; or
- introduce malware, automate abusive requests, or help another person do any prohibited act.
6.Intellectual property
Wave owns or licenses the website software, visual design, original copy, data selection, arrangement and presentation, and derived calculations, except for third-party material and facts that cannot be owned. These Terms do not transfer any intellectual property right to you.
“Smoothcomp” and other organiser, federation, event and academy names are used only to identify the relevant source or subject. Their use does not imply affiliation or endorsement.
7.Privacy and public visibility
Use of the website is also governed by the Privacy Policy. Athlete and competition information displayed by Wave is public and may be indexed, cached, quoted or archived by search engines and other third parties outside Wave's control.
8.Third-party services, links and support
The website relies on third-party infrastructure and may link to external websites. Wave does not control third-party availability, security, content, privacy practices or terms. A link is provided for convenience and does not amount to endorsement. You access third-party services at your own risk.
Visitors may choose to support Wave through its external Buy Me a Coffee page. Contributions are voluntary, are not payments for competition records or additional rights, and do not affect rankings, records, listings or editorial decisions. They are not represented as tax-deductible charitable donations. Buy Me a Coffee and its payment providers handle the transaction under their own terms.
9.Changes, suspension and availability
Wave may correct, add, remove, reclassify or stop publishing records, features or pages. Wave may apply reasonable technical restrictions, suspend access, or discontinue all or part of the service to protect people, data, legal rights, security or service availability.
No continuous, uninterrupted or permanent availability is promised. Maintenance, provider outages, source changes, security events and other circumstances may interrupt the service.
10.Consumer rights
Nothing in these Terms excludes, restricts or modifies a guarantee, right, remedy or liability that cannot lawfully be excluded, including any applicable rights under the Australian Consumer Law. Any exclusion or limitation in these Terms applies only to the maximum extent permitted by law.
11.Disclaimer
Subject to the non-excludable rights above, the website and all content are provided “as is” and “as available”. Wave does not warrant that information is accurate, complete, current, suitable for a particular purpose, free from harmful components, or continuously available.
To the maximum extent permitted by law, Wave excludes implied warranties and is not responsible for errors in source records, mistaken identity, delayed updates, third-party conduct, search-engine copies, or decisions made in reliance on website content.
12.Limitation of liability
To the maximum extent permitted by law, Wave and its operator will not be liable for indirect, incidental, special or consequential loss, loss of opportunity, loss of reputation, loss of data or loss arising from reliance on a public competition record, whether in contract, tort (including negligence), statute or otherwise.
Where liability cannot be excluded but may lawfully be limited, Wave's liability is limited, at Wave's option, to supplying the relevant service again or paying the reasonable cost of having the service supplied again. This limitation does not apply where the law prohibits it.
13.Responsibility for misuse
You are responsible for loss reasonably caused by your unlawful use of the website, deliberate misuse of personal information, infringement of third-party rights, security interference, or material breach of these Terms. This clause does not require you to compensate Wave for loss caused by Wave's own negligence, unlawful conduct or breach.
14.Changes to these Terms
Wave may update these Terms to reflect changes to the service, law, risks or providers. Changes apply prospectively from the updated effective date shown above. Continued use after an update means you accept the revised Terms.
15.Governing law
These Terms are governed by the laws of Queensland, Australia. You and Wave submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them. Mandatory laws in another jurisdiction continue to apply where they cannot lawfully be displaced.
16.General
If a provision is invalid or unenforceable, it is read down to the minimum extent necessary and the remaining provisions continue. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy constitute the agreement governing use of the website.
